Lapse of insurance or uninsured status can mean a loss of your rights

Inspired and funded by the Insurance Industry, California Civil Code Section 3333.4, may not have your best interests at heart. Suppose you were sitting in your parked automobile waiting for someone who was running an errand. Along comes a driver who is distracted and he runs into you. You sustain permanent injuries and have to go on disability. If your car was not insured at that moment, you couldn't recover damages for all of your pain and suffering. This is now the law.

California Medical Association (CMA) helps doctors...not patients...win cases

Imagine being in the hospital and being prepped for surgery. Your circumstances dictate that the doctor amputate your right leg. Now suppose you wake up from surgery and find your doctor removed the wrong leg (your good leg). California Civil Code Section 3333.3 limits your damages for pain and suffering and disability to $250,000 for the effects of your doctor's incompetence. This law, funded by the CMA, protects doctors, not patients.

Physician's negligence can deprive your heirs

Here's another law that protects the doctors but fails to consider their potential incompetence. Say you're in the hospital and your doctor gives you the wrong medication which, unfortunately, ends in your death. No matter how many children you have or what your life's circumstances or those of your family are at the time of your death, they are allowed to collect no more than $250,000 for the loss of your love, care, companionship and income. This law was also backed by CMA (California Medical Association).

If you're treated unfairly or paid slowly, you can't sue insurance companies

Recent California propositions 30 and 31 repealed an earlier law that passed in the State Legislature allowing you to sue your insurance company for unreasonable treatment or settlement costs. So now if, for instance, you're standing on a sidewalk and get hit by a driver, who causes you serious injury, and his insurance company drags the case on an on depleting your assets, you can no longer bring a lawsuit against them. After the insurance industry spent $50 million to win these, you also no longer have a right to sue if your claim was not handled promptly.

HMO Kaiser members giving up Constitutional rights?

It was recently mandated that if you're a HMO Kaiser/Permanente member, that in all likelihood, you may have given up your right to a jury trial to bring a malpractice suit against your insurance company for their negligent care. That means your only recourse is probably arbitration, part of which you may have to pay whether you win or lose.

Construction worker's rights in question

In a recent case decided by the California Supreme Court, construction workers, who sustained a work-related injury due to negligence on the part of the general contractor (not their employer), under most circumstances can NOT sue--no matter how critical the injuries. Instead, the injured worker must accept Worker's Compensation benefits, which do not pay for things such as pain, suffering and non-work related disabilities. This was decided in a case known as Privett and Toland.
